2. Scope of Works 

The Company shall carry out works as set out in the quotation provided to the Customer. Acceptance of the quotation confirms acceptance of these Terms and Conditions. 

3. Standards of Workmanship 

The Company shall perform the works: 

• In a professional and workmanlike manner at all times. 

• Using materials of satisfactory quality as agreed in the quotation. 
• In accordance with applicable laws, regulations, and health and safety requirements. 

4. Variations to the Contract 

Any variation to the agreed works must be confirmed in writing by the Company. Additional costs will be charged at a fair and reasonable rate if no quotation is issued. 

5. Unforeseen Site Conditions 

The Company shall not be liable for unforeseen site conditions, including but not limited to hidden ground defects, drainage issues, or tree roots, discovered during the works. Where such conditions arise, the Customer will be informed and works postponed until resolved at the Customer’s cost. 

6. Materials and Property 

All materials, equipment, machinery, and temporary works remain the property of the Company until the contract sum has been paid in full. 

The Company will not remove machinery, barriers, or temporary works until full payment has been received. 

7. Payment Terms 

• Deposit/Stage Payments: At the sole discretion of the Company, including amount and timing. 

• Balance in Full: Payment is required on the day of completion of the works. 

• Invoice Period: All invoices must be settled within five (5) working days of completion. 

• Late Payment: Failure to pay within this period will result in interest being charged at 5% of the outstanding balance per week, accruing until full payment is received. 
• Disputes: In the event of a dispute, the Customer may withhold only a reasonable amount reflecting the cost of rectifying the disputed works. 

8. Completion and Delays 

The Company shall use best endeavours to complete works within any agreed timeframe but shall not be liable for delays beyond its reasonable control, including inclement weather or delays in obtaining materials. 

9. Guarantees 

The Company provides a 5-year guarantee on all driveway services, including: 

• Resin Bound Driveways 

• Block Paving 

• Patios 

• Tarmacing 

• Commercial Surfacing Works 

Guarantees are conditional upon the works being properly maintained. They exclude damage caused by misuse, heavy vehicle impact, oil or chemical spills, or lack of proper aftercare. 

10. Claims Under Guarantee 

All claims must be made in writing within 14 days of the defect becoming apparent. Guarantees are not transferable unless agreed in writing, subject to an administration fee. 

11. Limitation of Liability 

The Company shall not be liable for indirect or consequential losses. Liability is limited to the value of the works carried out under the contract. 

12. VAT 

VAT is chargeable at the prevailing rate at the time of completion. 

13. Cancellation Policy 

The Customer has the right to cancel the contract in accordance with consumer law. A 14-day cooling-off period applies from the date of accepting the contract, whether in writing or verbal, during which cancellation will incur a charge.

If the contract is cancelled after the 14-day cooling-off period, a 30% cancellation fee of the total contract value will be charged to cover administrative and material costs.

Any materials purchased or works commenced prior to cancellation within this period will also be chargeable.
